Legal heir certificate
An official document that names the legal heirs of a person who has died.
A legal heir certificate is an official document naming the legal heirs of someone who has died. Families often need it to claim bank money when there’s no nominee. It’s issued by a state authority, and the process varies by state.
What it does
A legal heir certificate answers a single question: who are the recognised heirs of the person who died? It lists them, the spouse, children and parents as applicable, so that institutions, employers and authorities know whom to deal with. Families use it to claim bank balances, provident fund, pension, insurance and similar dues when there was no nominee, and for routine matters like transferring utilities or claiming salary arrears.
Where to get it
A competent state authority issues it, usually the local revenue office (the tahsildar or an equivalent), after verifying the family. Because it is a state document, the exact office, form and timeline differ across states, so check your state’s revenue department. It is generally quicker and cheaper to obtain than a court certificate.
Legal heir certificate versus succession certificate
These are often confused but are different. A legal heir certificate names the heirs and comes from a state revenue authority; a succession certificate comes from a civil court and specifically authorises collecting the deceased’s debts and securities, which banks may require for larger claims. Probate is a third thing again, relating to a will. See claiming a parent’s money after they die.
Questions people ask
When do I need a legal heir certificate?
Mostly when a parent or relative dies without naming a nominee. Under RBI's 2025 directions, a bank can accept a legal heir certificate from a competent authority, or a declaration by an independent person, for claims up to its threshold limit.
Is a legal heir certificate the same as a succession certificate?
No. A legal heir certificate identifies who the heirs are and is issued by a state authority. A succession certificate is issued by a civil court and authorises a person to collect debts and securities of the person who died. Banks may ask for a succession certificate for larger claims.
Who issues a legal heir certificate?
A competent state authority, usually the local revenue office. The issuing office and the process vary by state, so check with your state's revenue department.
